Family Law Writing Competition Co-sponsored by Hofstra Law School and AFCC

Hofstra Law School and the Association of Family and Conciliation Courts are sponsoring the annual Family Law Writing Competition to celebrate the establishment of Hofstra’s LL.M. program in Family Law. The competition is run in cooperation with the editorial staff of Family Court Review, which is the academic and research journal of AFCC. Family Court Review is an interdisciplinary and international journal published quarterly by Wiley-Blackwell Publishing and in cooperation with The Center for Children, Families and the Law at Hofstra Law School. Family Court Review contributes to and facilitates discourse among the judicial, legal, mediation, mental health and social services communities.

Phil Stahl, AFCC member from Queen Creek, Arizona, has written a new book: Conducting Child Custody Evaluations—From Basic to Complex Issues.
Janet Walker, AFCC member from Newcastle Upon Tyne, United Kingdom, was awarded an OBE (Officer of the Order of the British Empire) by the Queen in the New Year Honours list last January and went to Buckingham Palace to be invested by Prince Charles on July 9.

Special Issue of Hofstra Law Review on Collaborative Law Available Online


The Winter 2009 issue of Hofstra Law Review (Vol. 38, No. 2) is a special symposium issue dedicated to collaborative law. It includes the final version of the Uniform Collaborative Law Act (UCLA), approved by the National Conference of Commissioners on Uniform State Laws at its 118th annual Conference in July 2009. The law review articles arose from a conference on collaborative law held at Hofstra Law School in November 2009 and are written by leading academics, judges, collaborative law practitioners, and other professionals providing a behind-the-scenes look at the drafting process of the UCLA; insight into conference discussions; the repercussions that intimate partner violence may have on a collaborative law process; and the biological, ethical, and psychological issues that arise in the context of collaborative law.

Andrew Schepard, AFCC member from Hempstead, New York, has been nominated as one of the best law teachers in the United States as part of the “What the Best Law Teachers Do” project at Washburn University School of Law. The goals of this project are to identify the best law teachers in America, synthesize the principles by which they teach, and share these principles and the stories of these exceptional teachers by documenting them in a book. Andy is the Director of the Center for Children, Families and the Law and a Professor of Law at Hofstra University School of Law, as well as the Editor of Family Court Review.


Jill Egizii, AFCC member from Leland Grove, Illinois, is hosting a new radio show called Family Matters on www.syndicatednews.net, which airs on Wednesday nights biweekly from 7-8:30 EST. Jill is the author of a novel titled The Look of Love.

In Memoriam
Ellen Cowell, Founding Member of the AFCC Missouri Chapter


Ellen Kaye Cowell, nee Esterly, 42, died Wednesday, August 4, 2010, at her home in Webster Groves, Missouri, surrounded by her family after a courageous three-year battle with cancer. She graduated from Belleville Township East High School in 1985. After obtaining her BS degree from the University of Missouri in 1989, she went on to Auburn University and received her Masters degree in Marriage and Family Therapy in 1991. She eventually worked with the St. Louis County Family Court as a mediator, a role she held for sixteen years. Ellen and AFCC Board member Andrea Clark were instrumental in founding the AFCC Missouri Chapter. AFCC extends condolences to Ellen’s colleagues, friends and family.

Child custody evaluators should know how to differentiate between types of violence, because a one-size-fits-all approach to custody can endanger both mums and kids, according to new American research.


The University of Illinois study reveals that evaluator's beliefs generally fall into two categories, and one group is far more likely to prioritize safety for women and children when making custody decisions.

Eliminating Child “Custody” Tries to Ease Pain of Separation

The “c” word may soon be a thing of the past, at least for families negotiating the most painful aspect of separation and divorce: custody of their children.


Changes proposed for B.C.’s Family Relations Act include eliminating the terms “custody” and “access,” and replacing them with new concepts of “guardianship” and “parental responsibilities.”

Adults Recall Negative Events Less Accurately than Children, Study Finds

Emotions—particularly those provoked by negative events—can cause distorted, inaccurate memories, but less often in children than in adults, according to a new Cornell study. The findings, published online in the Journal of Experimental Child Psychology, contradict prevailing legal and psychological thinking and have implications for the criminal justice system, report Charles Brainerd and Valerie Reyna, professors of human development and co-authors of the 2005 book The Science of False Memory.

The Associated Press reports on recent cases denying custody and/or visitation to a parent making use of medical marijuana: More than a decade after states began approving marijuana for medical use, its role in custody disputes remains a little-known side effect. While those laws can protect patients from criminal charges, they typically haven't prevented judges, court commissioners or guardians ad litem from considering a parent's marijuana use in custody matters—even in states such as Washington, where complying patients "shall not be penalized in any manner, or denied any right or privilege," according to the law.

New iPhone App Receives International Attention

Michelle O'Neil, a divorce attorney in Dallas, Texas, recently posted about an app she helped create for the iPhone: Divorce Cost & Preps. She writes: The app serves two purposes. First, a person contemplating divorce can assess the hidden and direct costs of divorce, such as the cost of providing two houses, two wardrobes for the children, or transportation costs for exchanging the children between houses. Second, the app gives divorce clients a list of information and documents to gather for their lawyer to assist preparation of their divorce.

Dianna J. Gould-Saltman, AFCC member from Los Angeles, California, was appointed by Governor Arnold Schwarzenegger to a judgeship in the Los Angeles County Superior Court. Gould-Saltman has been a partner at Gould-Saltman Law Offices since 1997 and was a sole practitioner at the firm from 1994 to 1997. Previously, she was an attorney for the Law Offices of Lorraine C. Gollub from 1986 until 1994. Gould-Saltman worked for Gollub & O’Connor as a law clerk, then associate attorney from 1984 until 1986. She earned a Juris Doctorate degree from Southwestern University School of Law and a Bachelor of Arts degree from the University of California, Irvine. She is presently on the Board of Directors of AFCC.

Denver Annual Conference a Great Success

AFCC’s 47th Annual Conference, June 2–5, 2010, in Denver, Colorado, attracted over 1,000 attendees from 19 countries. The conference theme, Traversing the Trail of Alienation: Rocky Relationships, Mountains of Emotion, Mile High Conflict, formed an energizing base for the conference.

The AFCC Board of Directors granted Chartered Chapter status to AFCC’s Minnesota and Ontario Chapters, and granted Provisional Chapter status to Washington State. Congratulations to all for all their hard work!

Justice Harvey Brownstone, AFCC member from Toronto, ON, is the first sitting family court judge to host his own television program, Family Matters, filmed in Victoria, BC. The show will combine educational segments, with expert guests as well as an interactive component designed to answer viewer’s questions using YouTube, Skype and email submissions.
Joseph Harman, AFCC member from Emu Plains, NSW, Australia, has been appointed as Federal Magistrate in the Court of Australia the Parramatta Registry.
Debra Lehrman, AFCC member from Fort Worth, TX, was appointed by Texas Governor Rick Perry as Justice to the Supreme Court of Texas. Judge Lehrman is a previous president of the AFCC Texas Chapter.
Marsha Kline Pruett, AFCC member from Northampton, MA, has been awarded the 2010 Men-in-Families Best Research Article Award for an article she co-authored, “Promoting Fathers’ Engagement With Children: Preventive Interventions for Low-Income Families,” that appeared last year in Journal of Marriage and the Family.

AFCC’s 12th Annual Silent Auction

AFCC’s 12th Annual Silent Auction was held during AFCC’s 47th Annual Conference. This year’s silent auction was a great success and raised over $10,000. Proceeds from the auction are earmarked towards AFCC’s special projects and initiatives to support children and families struggling with separation and divorce. This year the funds raised will be used to support projects including AFCC’s Court-Involved Therapists Task Force and Child Custody Consultation Task Force. Accessing Handouts for the 47th Annual Conference in Denver

AFCC's 47th Annual Conference, June 2–5, 2010, in Denver, Colorado, is going green! Conference session handouts will be provided to registrants on a CD or flash drive. In addition, the entire proceedings is available online. Conference registrants will receive a letter via email—or if no email was provided, via standard mail—containing the online access instructions. Access is already available and will remain so for two months after the conference.

Things to Do in Denver

The beginning of June is a wonderful time to be in Denver! Temperatures should be moderate: lows in the 50s and highs in the 70s to low 80s. Denver receives 300 days of sunshine a year. This makes for the perfect time to get outside!

During the first weekend in June, the 39th Annual People’s Fair takes place, an outdoor celebration put on by the Capital Hill United Neighborhoods (CHUN) to celebrate the diverse Denver urban community and its residents.

Top Ten Mediation Screening Questions

Prior to conducting mediation it is important to screen the case to determine whether or not mediation is appropriate and, if it is, what the best way to proceed might be, whether that is to bring the parties together, or to conduct shuttle mediation. The following questions are based upon an individual face-to-face screening conducted with each of the parties who have been court-ordered to attend mediation. The screening is conducted immediately prior to the start of mediation.

AFCC Parenting Coordination Trainings in Chicago

AFCC, in collaboration with Loyola University Chicago School of Law's Child and Family Law Center, is presenting two training programs, June 14-17, 2010. Parenting Coordination: Helping High Conflict Parents Resolve Disputes, with presenter Joan B. Kelly, Ph.D., will be held June 14–15, 2010. Advanced Issues in Parenting Coordination: Attachment, Personality Disorders, Alienation and Difficult Clients will be presented by Arnold T. Shienvold, Ph.D., on June 16–17, 2010. Both trainings will take place at the Philip H. Corboy Law Center in Chicago, Illinois.

A Young Professional’s Reflections
AFCC is beginning a new Mentorship Program to help foster new and young professionals in the field of family law. Although the program is new, the process is not. Many professionals have found informal mentors within AFCC and this is the first in a series of reflections about AFCC and that process written by Rebecca Stahl. Rebecca graduated from the University of Arizona College of Law in May 2008 and is licensed in Arizona and California.

AFCC Ontario Chapter Looking for Elements of Ideal Family Court
AFCC Ontario is exploring a policy paper that designs and describes the elements of an ideal Family Court for children and families involved in separation, divorce or child protection issues that is research-informed. The Chapter would like to hear from others about available services for children and families in their jurisdiction. The Chapter wants to learn from others' experiences and expertise, generate knowledge and share what is learned with partners in the community to inform policy.
